Terms & Conditions

The terms that apply to bookings, appointments, treatments, payments and use of The Kneadful Nook's services.

1. About The Kneadful Nook

The Kneadful Nook is a registered business name of Kim Lakeman, a sole trader in Jersey.

These Terms & Conditions apply to appointments, treatments, bookings, payment arrangements, use of The Kneadful Nook website and related business communications.

Nothing in these Terms & Conditions excludes, restricts or replaces a statutory consumer right that cannot lawfully be excluded or restricted.

2. Treatments and services

The Kneadful Nook provides massage, Reiki and treatment packages as described on its website and booking platform.

Treatment descriptions are intended to explain the general nature of the services offered.

Treatments are complementary wellbeing services and are not a substitute for medical diagnosis, medical treatment or advice from an appropriately qualified healthcare professional.

Clients should seek appropriate medical advice where necessary and should disclose information relevant to treatment safety and suitability during the consultation process.

3. Prices

Current treatment durations and prices are displayed on The Kneadful Nook website and booking platform.

The price applying to a confirmed appointment will normally be the price displayed or otherwise agreed when the appointment is booked, unless an obvious error has occurred.

Prices may change for future bookings.

A subsequent price change will not normally alter the agreed price of an existing confirmed appointment unless required by law or expressly agreed with the client.

4. Booking appointments

Treatments are available by scheduled appointment only.

Walk-in appointments are not available.

Online bookings are arranged through SumUp Bookings.

An appointment is treated as confirmed when confirmation is provided through SumUp or directly by The Kneadful Nook.

Clients are responsible for ensuring that contact, booking and other information supplied is accurate.

5. Payment and securing an appointment

The normal treatment price is not taken when an appointment is booked.

Payment for a treatment that the client attends is due in person at the appointment.

When booking through SumUp, the client may be required to provide card details to secure the appointment against an applicable no-show charge.

Card information is handled through SumUp.

The Kneadful Nook does not receive, store or have access to the client's full payment-card details.

Where the applicable conditions are satisfied, The Kneadful Nook may use functionality provided by SumUp to initiate the authorised no-show charge described in these Terms.

6. Rescheduling

The Kneadful Nook understands that circumstances and plans sometimes change.

Clients may request to reschedule an appointment, subject to availability.

Please provide as much notice as reasonably possible.

Where an appointment is successfully rescheduled, the original appointment will not be treated as a no-show.

The Kneadful Nook does not currently charge a separate fee solely because an appointment has been successfully rescheduled.

7. Cancellations

If you wish to cancel rather than reschedule an appointment, please provide at least 24 hours' notice.

Cancellation should be completed through the booking service where available or by contacting The Kneadful Nook.

If less than 24 hours' notice can be provided, please contact The Kneadful Nook as soon as possible.

The Kneadful Nook does not currently specify a separate late-cancellation charge.

A late cancellation and a no-show are not treated as the same thing for the purpose of the 15% no-show charge below.

8. Statutory consumer rights

Bookings made online or by another remote means may be subject to statutory consumer protections under Jersey law.

The Kneadful Nook's contractual cancellation, rescheduling and no-show terms are not intended to remove, restrict or replace any statutory right that applies to a particular booking.

Where a mandatory Jersey consumer-protection rule conflicts with a provision in these Terms & Conditions, the statutory rule will take precedence.

9. No-shows

A no-show occurs where a client fails to attend a confirmed appointment and has not cancelled or successfully rescheduled the appointment.

In the event of a no-show, The Kneadful Nook may charge 15% of the price of the booked service.

Where card details were provided through SumUp to secure the booking, the charge may be initiated through SumUp in accordance with the booking authorisation and applicable platform arrangements.

The Kneadful Nook retains discretion not to apply the no-show charge where circumstances reasonably justify doing so.

10. Clients under 18

A client under 18 will only be treated where a parent or guardian is present.

A parent or guardian may be required to provide or confirm relevant information, participate in the consultation process and provide appropriate consent.

The Kneadful Nook may decline to proceed with an appointment where appropriate parental or guardian presence or consent is not available.

11. Consultation, consent and health information

Before treatment, clients may be required to complete or review a consultation and consent form.

Clients must provide information that is accurate and complete to the best of their knowledge, particularly where it may affect treatment safety or suitability.

Relevant information may include:

  • medical conditions;
  • allergies;
  • injuries;
  • medication;
  • pregnancy;
  • recent surgery or medical treatment;
  • cardiovascular or circulatory conditions;
  • skin conditions;
  • contraindications; and
  • other health information relevant to the proposed treatment.

Clients should inform the practitioner if relevant information changes.

If relevant information is withheld, incomplete or inaccurate, The Kneadful Nook may be unable to assess whether treatment can safely or appropriately proceed.

The practitioner may reasonably decline, adapt, postpone or stop a treatment where considered necessary for safety, suitability, professional practice or client wellbeing.

Consent to treatment may be withdrawn at any time.

12. Conduct and professional boundaries

Clients and the practitioner are expected to treat one another with dignity and respect.

The Kneadful Nook may refuse to begin or may end an appointment where behaviour is:

  • threatening;
  • abusive;
  • discriminatory;
  • harassing;
  • sexual or otherwise inappropriate;
  • unsafe; or
  • otherwise incompatible with a professional treatment environment.

Where a treatment is ended because of serious inappropriate conduct by a client, this will not necessarily create an entitlement to a refund.

Nothing in this section affects any statutory rights that apply.

13. Changes or cancellations by The Kneadful Nook

Appointments are subject to practitioner and premises availability.

An appointment may occasionally need to be changed or cancelled because of illness, emergency, premises issues or other circumstances outside The Kneadful Nook's reasonable control.

Where this occurs, reasonable efforts will be made to contact the client and arrange another suitable appointment.

A client will not be charged a no-show fee where The Kneadful Nook cancels the appointment.

14. SumUp

SumUp is a third-party service used for online booking and payment-related services.

Use of SumUp is also subject to SumUp's applicable terms, privacy information and platform rules.

The Kneadful Nook is not responsible for temporary outages or technical failures within SumUp's systems that are outside The Kneadful Nook's reasonable control.

Where reasonably possible, assistance will be provided if a client experiences a booking issue.

15. Facebook and social media

The Kneadful Nook may use Facebook and other business-controlled social-media channels to publish business updates, treatment information, availability information, news, general wellbeing content, promotional material and links to the website or booking service.

Social-media posts are provided for general information.

Because posts may remain visible after circumstances change, clients should check the current website or booking platform where up-to-date information is important.

For an individual appointment, the details contained in the client's confirmed booking will normally take precedence over general social-media content, subject to applicable law.

Reviews, comments, recommendations and other user-generated content are also subject to the relevant social-media platform's rules.

The Kneadful Nook may moderate or remove content from business-controlled social-media areas where reasonably necessary, including content that is abusive, unlawful, discriminatory, misleading, spam or otherwise inappropriate.

A customer's publication of identifiable feedback on Facebook does not automatically give The Kneadful Nook permission to reproduce it elsewhere for a separate promotional purpose.

Appropriate permission will be obtained where required before identifiable customer feedback is deliberately republished in separate marketing material.

16. External links and third-party services

The website and business social-media pages may contain links to external services, including SumUp, Facebook and Google Maps.

External providers operate their own systems and apply their own terms and privacy arrangements.

The Kneadful Nook is not responsible for content or technical availability on an external website or platform that it does not control.

Nothing in this section removes any responsibility The Kneadful Nook has under applicable law for its own services.

17. Consumer rights and standard of service

Treatments will be provided with the level of care and skill required by applicable Jersey law.

Nothing in these Terms & Conditions is intended to exclude, restrict or replace a right or remedy available to a consumer under Jersey law.

Where a provision conflicts with a mandatory consumer-protection requirement, the statutory requirement applies.

18. Website and published information

Reasonable care is taken to keep information published by The Kneadful Nook accurate and current.

Website and social-media information concerning treatments is provided for general information and is not medical advice.

Prices, availability, business hours and other information may change.

Where general published information differs from details specifically confirmed for an individual appointment, the confirmed booking details will normally apply, subject to applicable consumer law.

19. Website security and acceptable use

Users must not knowingly misuse the website or attempt to interfere with its security, availability or operation.

Prohibited conduct includes:

  • attempting to obtain unauthorised access to the website, server, hosting environment or connected systems;
  • knowingly introducing malware or malicious code;
  • attempting to bypass security controls;
  • deliberately interfering with website operation;
  • submitting malicious or abusive automated requests; or
  • using the website for an unlawful purpose.

Nothing in these Terms authorises conduct prohibited by applicable Jersey law, including legislation concerning computer misuse.

20. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Subject to applicable law, The Kneadful Nook is not responsible for losses that:

  • could not reasonably have been foreseen when the relevant agreement was made; or
  • result from materially inaccurate or incomplete information supplied by a client.

Clients remain responsible for seeking appropriate medical advice where necessary and for informing the practitioner about information relevant to treatment safety and suitability.

21. Complaints

If you are dissatisfied with a treatment, booking, no-show charge or other aspect of the service, please contact The Kneadful Nook as soon as reasonably possible so that the matter can be reviewed.

Nothing in this section affects a client's right to obtain advice or assistance from Jersey Trading Standards or to exercise any other legal right or remedy.

22. Privacy

Personal information is handled in accordance with The Kneadful Nook's Privacy Notice and applicable Jersey data-protection law.

Additional third-party privacy terms may also apply where a client chooses to use services such as SumUp, Facebook or Google Maps.

23. Changes to these Terms & Conditions

These Terms & Conditions may be amended where necessary to reflect changes to:

  • services;
  • prices or booking arrangements;
  • business practices;
  • technology;
  • regulatory guidance; or
  • applicable law.

The version applying to an appointment will normally be the version in force when the booking was confirmed, except where a change is required by law or another change is expressly agreed with the client.

The version number and last-updated date at the top of these Terms identify the current version.

24. Governing law

These Terms & Conditions are governed by the laws of Jersey.

Any dispute will be subject to the jurisdiction of the Jersey courts, subject to any mandatory consumer rights that apply.
